A New Mexico judge dismissed all charges against three suspects tied to a compound where alleged Muslim extremists reportedly trained children to be school shooters. District Judge Emilio Chavez on Wednesday dismissed charges against three of the five defendants, ruling that authorities violated the state’s “10-day rule.”
FOX News Child abuse charges against Lucas Morton, Subhannah Wahhaj and Hujrah Wahhaj were dropped because prosecutors missed the 10-day limit for an evidentiary hearing to establish probable cause.
During a separate hearing Wednesday, Judge Jeff McElroy dismissed the same charges against fellow defendants, Siraj Ibn Wahhaj and Jany Leveille. However, charges leveled against them on Friday, in connection to the death of a missing 3-year-old boy, remained.
Siraj Ibn Wahhaj, the boy’s father, and Leveille were charged with abuse of a child resulting in the death of a child and conspiracy to commit abuse of a child, Taos County Sheriff Jerry Hogrefe announced.
The five suspects were arrested by authorities after an Aug. 3 raid following a monthslong search investigating the disappearance of Abdul-ghani Wahhaj, a 3-year-boy with severe medical issues who went missing from Georgia in December. The occupants of the compound were “most likely heavily armed and considered extremist of the Muslim belief,” an official said at the time.
Health officials confirmed earlier this month that the discovered remains were positively identified as the 3-year-old’s.
Siraj Ibn Wahhaj was allegedly training children to commit school shootings, according to prosecutors, who later alleged that the juveniles were taught how to use firearms, as well as tactical techniques, in order to kill teachers, law enforcement and other institutions they found corrupt.

It is time for the US Marshals to show up with federal charges and also put anyone of these vermin on ICE detainers who are not US citizens. New Mexico followed its laws but the feds still have the opportunity to nail these ragheads to the wall.

It would appear that the lawyers F’ed up, except for the fact the judge has been ruling in favor of the jihadis since the beginning. Death threats haven’t been enough to deter this judge from her Muslum partiality. This supposed father knew about his sons medical issues, this is an ‘honor’ killing of sorts, or perhaps to punish the mother, but he will use the guise of religious freedom because he read the poison of Quran over the dying child.
New Mexico is not a state to trust with managing a political trial like this. Most of it is like the backwoods.

The judge was upholding the law. I think this was referring only to the child abuse charge for death of their son. The prosecutors thought the defendants inability to make bail made it so the 10-day rule for a preliminary trial didn’t apply. The judge actually delayed his ruling to give them time to refile. They did NOT refile. Apparently, though, “Prosecutors have said they would present new evidence of a plot by the defendants to attack “corrupt institutions.” How did they let this slip? Why were such incompetents put in charge of something like this?

The Judge was following the Law. The District Attorney’s office dropped the ball, either through incompetence or by design. The judge even gave them time to re-file which they didn’t do. Only the Feds can salvage this situation, but who knows what has happened to the evidence if even collected, considering they destroyed the compound already. The DA should be re-called, the Assistant DAs should be fired. The Feds should be involved. The child who was kidnapped and killed was taken across state lines which should qualify for Federal involvement.
New Mexico is a beautiful but strange state and Taos County is rural and remote, and not terribly sophisticated .Although NM is blue, because it is poor, it remains in many ways the wild west. Independence is guarded. People just want to be left alone and so leave others alone. A bit of a dichotomy. Which simply takes you back to the DA’s office not doing their job.
