An appeal by a Muslim prisoner tested what Wisconsin considers more important: the inmate’s Islamic religious beliefs or a transgender male (biological female) prison guard’s right to be treated the same as her male colleagues.

According to the Washington Times (via PJ Media h/t Marvin W), a Muslim male prisoner must be exempt from strip searches by a transgender male prison guard (who is a biological woman), a three-judge panel of the U.S. Court of Appeals for the 7th Circuit has ruled. The panel said the Green Bay Correctional Institution violated the Muslim convict’s religious rights by not accommodating his Islamic beliefs, which dictate that he is forbidden from exposing his naked body to any woman but his wife. (You can bet they wouldn’t rule this way for a non-Muslim female prisoner who didn’t want a trannie female (biological male) prison guard touching her.
Inmates at the facility are subject to strip-searches whenever they leave or enter the prison and at other times deemed necessary. Strip-searches require a witness, and the female prison guard was present as a witness in accordance with the requirement back in 2016.
In March 2020, U.S. District Judge Pamela Pepper dismissed West’s case because his religious conviction did not outweigh Mr. Buhle’s right to identify as a man and be treated as such in the workplace. Throughout his incarceration, the 51-year-old West has filed multiple lawsuits alleging mistreatment by the prison system.
West, also known by his Muslim name of Mansa Lutalo Iyapo, is serving a 29-year sentence for a conviction on charges of armed robbery and being a felon with a gun. He is due for a 2024 release.

I completely agree with the new ruling but can’t help but wonder why such an exemption can be made for religious reasons but no other. Should female prisoners be subjected to strip searches by male prison guards who “identify” as women even if they have no specific religious objection? Should young girls be forced to share changing facilities with adult men who “identify” as women?
If this court recognizes that biological sex trumps “gender identity” for Muslim inmates in prison, then it should for everything else as well. No individual’s “right” to “identify” as the opposite gender trumps the rights of others to believe the biological reality of their sex. Hopefully, this ruling will result in more rulings that bring sanity back.
Recently, a number of women’s rights organizations have raised alarm bells regarding trans-identified males being given the ability to be sent to women’s institutions across the UK, Europe, Canada, and the United States. West’s challenge may have an impact on the interpretation of how prisons balance rights and protect inmates going forward.

If the appeals court believes his religious beliefs must not be “violated”, under so-called “sharia law” (his religious belief) our infidel common laws don’t apply to anybody of that “religion”, therefore he must be freed to commit more armed robberies against more infidels!
