These are ideas already attempted by former British PM Rishi Sunak with his ‘Rwanda plan’, and Italian premier Giorgia Meloni with her ‘Albania plan’. In both cases, activist judges blocked the programs, arguing that they were not supported by European law.

“The European Parliament approved on Tuesday a legislative change that could see asylum seekers arriving in the European Union transferred to unrelated countries before their claims are processed.
The change in the ‘safe third country’ concept, included in the Asylum Procedure Regulation (APR), removed the requirement for a link between an applicant and a transfer country, allowing national authorities to move people to states they have never been to.”
